Welcome to LegacyInBrush. By accessing or placing an order through our website, you agree to be bound by the following Terms of Service. Please read them carefully before using our service.

1. ABOUT OUR SERVICE

LegacyInBrush is a custom portrait art service that transforms photographs of people and pets into timeless portrait artwork. We offer:

  • Custom digital portrait files delivered via email
  • Premium gallery-wrapped canvas prints, fulfilled by Printful
  • A free watermarked preview before any payment is required
  • Human artist quality review on every order

2. ELIGIBILITY AND ACCOUNTS

2.1 Age Requirement

You must be at least 18 years of age, or have the consent of a parent or legal guardian, to place an order or create an account with LegacyInBrush.

2.2 Account Registration

When creating an account, you agree to provide accurate and complete information. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.

2.3 Account Termination by You

You may close your account at any time by contacting our support team. Pending or completed orders are not affected.

3. ORDERING AND FULFILLMENT

3.1 Order Process

Orders are placed by uploading a reference photograph, selecting a portrait style, and submitting your request. A free watermarked preview will be generated for your review before payment is required.

3.2 Preview and Approval

You will receive a watermarked preview of your portrait before completing your purchase. Payment is only required after you have reviewed and approved your preview. By approving and paying, you confirm that the portrait meets your expectations and authorize us to deliver the final file.

3.3 Digital Portrait Delivery

Upon payment, your high-resolution digital portrait file will be delivered to your email address within minutes. Digital files are sent in a standard image format suitable for personal printing and sharing.

3.4 Physical Canvas Print Orders

Physical canvas prints are produced and fulfilled by Printful, a US-based print-on-demand facility. Estimated delivery is 7–15 business days depending on your location. Delivery times may vary due to carrier conditions or customs processing. LegacyInBrush is not responsible for delays caused by third-party carriers or customs authorities.

3.5 Order Accuracy

You are responsible for reviewing your approved preview carefully before completing your purchase. We are unable to issue refunds for dissatisfaction with a portrait that was approved by the customer.

4. CONTENT AND INTELLECTUAL PROPERTY

4.1 Your Uploaded Photos

You retain full ownership of any photographs you upload to our platform. By uploading, you grant LegacyInBrush a limited, non-exclusive license to use the image solely for the purpose of generating your commissioned portrait.

4.2 Third-Party Consent

By uploading a photograph that includes other individuals, you confirm that you have the right or permission to use and submit that image for portrait creation. LegacyInBrush is not responsible for any claims arising from unauthorized use of another person’s likeness.

4.3 Portrait Artwork Usage Rights

Upon full payment, you own your delivered portrait and are granted a worldwide, perpetual license for both personal and commercial use. This includes personal display, printing and sharing, as well as commercial use in marketing materials, merchandise, business branding, print-on-demand products, publications, and advertising — at no additional cost. 4.4 LegacyInBrush Intellectual Property

All branding, website design, technology, and creative processes used to generate portraits remain the exclusive property of LegacyInBrush. You may not reproduce, reverse-engineer, or redistribute our platform or processes.

4.5 Content Restrictions

You may not upload photographs that:

  • Infringe on the intellectual property or privacy rights of any person
  • Contain illegal, sexually explicit, or harmful material
  • Depict minors in any inappropriate or exploitative manner
  • Violate any applicable local, national, or international law

5. DIGITAL DOWNLOADS

5.1 File Delivery

Digital portrait files are delivered to the email address provided at the time of purchase. Please ensure your email address is accurate before completing your order.

5.2 Re-download

If you do not receive your file or experience a delivery issue, please contact our support team. We will re-send your file at no additional charge.

5.3 Watermarked Previews

Watermarked previews are provided for approval purposes only and may not be used, shared, or printed as a final product. Full resolution, watermark-free files are delivered only upon completed payment.

6. ACCEPTABLE USE

By using LegacyInBrush, you agree not to:

  • Attempt to access, copy, or extract any part of our portrait generation technology
  • Use automated tools to submit bulk or fraudulent orders
  • Misrepresent your identity or the ownership of any uploaded image
  • Resell or sublicense orders placed through our platform without authorization
  • Engage in any activity that disrupts or overloads our systems

7. SERVICE AVAILABILITY

7.1 Uptime

We aim to keep LegacyInBrush available at all times, but we do not guarantee uninterrupted service. Occasional downtime may occur due to maintenance, updates, or factors beyond our control.

7.2 Scheduled Maintenance

We may perform maintenance at any time, with or without advance notice. We will make reasonable efforts to minimize disruption.

7.3 Service Changes

We reserve the right to modify, update, or discontinue any feature of our service at any time. We will provide reasonable notice for significant changes that may affect your experience.

8. PAYMENT AND BILLING

8.1 Payment Processing

All payments are processed securely through Stripe, a leading payment processing platform. By completing a purchase, you agree to Stripe’s terms of service. LegacyInBrush does not store your full card details.

8.2 Pricing

All prices are listed on our website and are subject to change. The price applicable to your order is the price displayed at the time of checkout.

8.3 Taxes

Prices may be subject to applicable local taxes. You are responsible for any taxes, duties, or customs fees associated with your order.

8.4 Failed Payments

If a payment fails, your order will not be fulfilled. Please ensure your payment information is accurate. Contact our support team if you experience any payment issues.

9. REFUNDS AND RETURNS

Our refund and return policy is described in full in our Refund Policy. Key points:

  • Digital portrait files are non-refundable once delivered
  • Refunds may be available in cases of technical failure or error on our part
  • Physical canvas print issues (damaged, defective) are handled per our Refund Policy

10. PRIVACY

Your privacy matters to us. Our Privacy Policy explains how we collect, use, and protect your personal data — including the photographs you upload to our platform.

11. DISCLAIMERS

11.1 Service Provided As-Is

LegacyInBrush is provided on an “as is” basis. We make no warranties, express or implied, regarding the fitness of our service for any particular purpose.

11.2 Portrait Results

While we make every effort to deliver high-quality portraits, artistic results may vary based on the quality of the photograph submitted. Our free preview step is designed to give you confidence before any payment is made.

11.3 Third-Party Services

We are not responsible for the performance or policies of third-party services such as Stripe or Printful. Their terms apply independently to their respective services.

12. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, LegacyInBrush and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to:

  • Loss of data, revenue, or business opportunities
  • Dissatisfaction with portrait results where a preview was approved
  • Delays or losses caused by third-party shipping carriers
  • Any claim exceeding the amount paid for the specific order in question

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless LegacyInBrush and its affiliates from any claims, damages, or costs — including legal fees — arising from your use of the service, your violation of these Terms, or your infringement of any third-party rights.

14. DISPUTE RESOLUTION

14.1 Informal Resolution First

Before initiating any formal dispute process, we ask that you contact our support team at support@legacyinbrush.com. Most issues can be resolved quickly through direct communication.

14.2 Binding Arbitration

If a dispute cannot be resolved informally, both parties agree to resolve it through binding arbitration under the rules of the American Arbitration Association, rather than through court proceedings.

14.3 Individual Claims Only

You agree to resolve any dispute with LegacyInBrush individually. You waive any right to participate in a class action or representative proceeding.

15. GOVERNING LAW

These Terms of Service are governed by and interpreted under the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any disputes not resolved through arbitration shall be subject to the exclusive jurisdiction of courts located in Wyoming.

16. ACCOUNT SUSPENSION AND TERMINATION

16.1 Termination by LegacyInBrush

We reserve the right to suspend or permanently terminate any account that violates these Terms, engages in fraudulent activity, or poses a risk to other users or our platform.

16.2 Effect of Termination

Upon termination, your right to access and use the service ends immediately. Completed orders remain unaffected, and delivered files remain yours to use under the terms of these agreements.

17. CHANGES TO THESE TERMS

We may update these Terms of Service at any time. When material changes are made, we will notify active users by email and post a notice on our website. Continued use of LegacyInBrush after changes take effect constitutes your acceptance of the revised Terms.

These Terms of Service, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and LegacyInBrush with respect to the use of our service. They supersede all prior agreements or understandings on the same subject matter.
